Terms of Service

This Agreement is between Digitino Emporium LLC, the legal owner and operator of Connectya AI (“Connectya AI,” “we,” “us,” or “our”), and the individual or entity (“Customer,” “you,” or “your”) accessing or using the Connectya AI platform, website, or services (collectively, the “Product” or “Service”).

By signing up, accessing, or using the Service, you agree to be bound by these Terms of Service (“Terms”). If you are using the Service on behalf of a company or legal entity, you represent and warrant that you have authority to bind that entity to these Terms.

If you do not agree with these Terms, or if your jurisdiction does not recognize them, you must not use the Service. Persons under the age of 13 are not authorized to use Connectya AI.

1. The Service

Connectya AI, owned and operated by Digitino Emporium LLC, provides cloud-based communication and AI automation tools. Features include, but are not limited to:

AI-powered voice interaction tools.

Number provisioning and call handling.

A customizable API and dashboard for AI call agents, coaching apps, or other lifelike AI applications.

2. Fees & Subscriptions

Pricing and plan details are outlined on our pricing page.

Customers agree to pay fees in accordance with their chosen plan and usage for each Subscription Period.

Payments are due within one (1) day of invoice.

Subscriptions are billed monthly or annually.

Prices may be changed with at least seven (7) days’ prior notice (via email or in-product notification).

Updated pricing takes effect at the start of the next Subscription Period.

A Free Trial may be offered for a limited number of days. During this period, your only responsibility will be usage-based costs.

3. Professional Services

Beyond standard technical support, Connectya AI may provide professional services, including:

Personalized consultations.

Advanced implementation assistance.

Optimization and strategy services.

4. Key Terms

Customer: The person or company accessing or using the Product.

Effective Date: The date you first accept this Agreement.

Invoice Period: Monthly or annually.

Payment Period: 1 day from date of invoice.

Provider: Digitino Emporium LLC, owner of Connectya AI.

Subscription Start Date: Date of sign-up.

Subscription Period: Monthly or annual billing cycle.

Non-Renewal Notice Period: 30 days before the Subscription Period ends.

5. Claims & Intellectual Property

Customer Content: You are responsible for any content or data you provide and must ensure it does not infringe third-party rights.

Provider Responsibility: Connectya AI (Digitino Emporium LLC) will ensure the Cloud Service itself does not infringe third-party rights when used as intended.

Intellectual Property: Connectya AI, including all trademarks, logos, software, and related intellectual property, is the exclusive property of Digitino Emporium LLC. Unauthorized use, reproduction, or distribution is strictly prohibited.

6. Arbitration & Dispute Resolution

Any disputes will be resolved exclusively by final and binding arbitration under the Federal Arbitration Act, administered by the American Arbitration Association, with a single neutral arbitrator. The arbitrator’s award is final and enforceable in any court of competent jurisdiction.

The prevailing party will be entitled to recover reasonable attorney’s fees and costs.

7. Indemnification

You agree to indemnify, defend, and hold harmless Digitino Emporium LLC (Connectya AI), its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising out of:

Your use or inability to use the Service.

Your violation of these Terms.

Your violation of applicable laws, rules, or regulations.

8. Attachments & Supplements

Acceptable Use Policy: You must comply with all applicable laws and refrain from unauthorized activities.

Privacy Policy: Data collection and usage practices are described in our Privacy Policy.

Our Intellectual Property Rights: Respect our trademarks, logos, and brand.

9. Changes to Terms

Digitino Emporium LLC reserves the right to update or modify these Terms at any time. Updates will be effective immediately upon posting at www.ConnectyaAI.com. The most current version supersedes all prior versions.
